These General Terms and Conditions of Sale (hereinafter also referred to as GCS) are valid between Compass DHM projects (with registered office in via Righe 13, 35028 Piove di Sacco (PD), Italy, VAT number 04879160283, REA PD - 425486) hereinafter referred to as "Compass DHM projects" and any person, natural or legal, who makes online purchases (of goods and/or services) on the website https://www.dhm-online.com hereinafter referred to as "Customer", "Consumer", or "Purchaser".
These conditions govern purchases made on the website https://www.dhm-online.com, or as Direct Sale, in accordance with the legal provisions set out in the Civil Code, Legislative Decree no. 70/2003 on information society services and electronic commerce, and Legislative Decree no. 206/2005 (the so-called Consumer Code), as amended by Legislative Decree no. 21/2014. The protection of confidentiality will be subject to the discipline of Legislative Decree 196/2003.
Article 0 - Definitions
Client - Consumer - Buyer: terms used in these GTC synonymously, they indicate the physical or legal entity that places an order for goods and/or services with Compass DHM projects.
Order Confirmation: indicates the Seller's acceptance of the Order transmitted to the Buyer Contract: shall mean the contract from time to time concluded between the Customer and the Seller for the purchase of goods and/or the provision of services subject to these General Conditions of Sale
Days: indicates working days, Monday to Friday (incl.) not including holidays
Working hours: means the Seller's working hours, specifically Monday to Friday from 09.00 to 12.00 and from 15.00 to 18.00.
Order - Ordering: terms used in these GTC synonymously, means an order for the purchase of Goods transmitted by the Buyer to the Seller
Product: means the good and/or the provision of a service offered by the Seller Site: the Internet site https://www.dhm-online.com
User: means the physical or legal entity that has already registered on the Seller's Site, and therefore a potential Buyer.
Direct sale: means a purchase made via e-mail, telephone contact or other means other than the https://www.dhm-online.com platform at Compass DHM projects
Seller: means Compass DHM projects, supplier of goods and/or services on https://www.dhm- online.com
Visitor: means any person who views the Seller's Site.
Article 1 - Seller
"Seller" means Compass DHM projects, with registered office in via Righe 13, 35028 Piove di Sacco (PD), Italy.
Article 2 - Acceptance of the General Conditions of Sale
The conditions set out in the preamble are an integral and essential part of this Contract.
Visitors wishing to make a purchase on https://www.dhm-online.com must first register to create a personal account, becoming a 'User'.
At this stage the User is required to complete the required fields by entering real and correct data in order to proceed with the delivery of the goods and by entering active and working e-mail addresses in order to be able to receive communications relating to their orders from the Seller. At any time the User may modify his data directly from the dedicated personal area. For registration it is necessary to be of legal age. If a minor is interested in purchasing Products on the Site he/she must involve a parent or guardian. Registration is free of charge.
The User may request the deletion of their account by contacting the Seller directly. The User account and transmitted data are protected by personal passwords and will be treated in accordance with EU Regulation 2016/679. For more information on this, please see the dedicated section "Privacy Policy".
All contracts will be concluded directly through the User's access to the Website corresponding to the address https://www.dhm-online.com, where he/she will be able to conclude the Contract for the purchase of the desired Product by carefully following the instructions and procedures provided.
It is possible to place the order via Direct Sale upon acceptance of the Quote provided by Compass DHM projects.
WARNING - These General Terms and Conditions of Sale must be examined by the Customer before completing the purchase procedure. The submission of the Order Confirmation implies full knowledge of them and their full acceptance. Customers are advised to provide for memorisation and/or hard copy of the GTC present at the time of purchase. At any time, however, the registered User may review these GTCs.
By accepting the General Terms and Conditions set out herein, the User also accepts the fact that Compass DHM projects may deactivate the account and refuse or cancel orders from: Users who have violated these General Terms and Conditions, Users who have provided false, incomplete or otherwise inaccurate identification data, Users who have not completed payment for orders previously placed. Compass DHM projects reserves the right to inform the competent Authorities in case of any criminal and/or civil liability.
Article 3 - Product Presentation, Sales Prices
All sales prices of the Products shown on the https://www.dhm-online.com website are in Euro and VAT is explicitly stated in accordance with the law. Packaging and shipping costs are not included in the purchase price, except where specifically indicated. These are indicated and calculated at the conclusion of the purchase process before payment is made.
The prices of the articles visible on the Site may change from time to time according to the adjustment of our suppliers' price lists. In the event of a computer error, manual, technical, or any other nature that may result in a substantial change not foreseen by Compass DHM projects, of the sale price to the public, the purchase order will be considered invalid and cancelled and the amount paid by the Customer will be refunded within 14 days from the day of cancellation.
Products will be invoiced according to the rates in force at the time of order confirmation.
The Products offered comply with current Italian legislation and applicable standards in Italy and Europe.
Compass DHM projects reserves the right to withdraw any Product from the Site at any time and/or remove or publish any type of material and/or content. It also reserves the right to modify and/or remove any form of promotion: offers published on the Site are of limited duration and with limited quantity of Products.
Unless otherwise specified in the quotation, quotations constitute an invitation to tender and may be changed at any time without notice. Unless a different period is specified, the prices quoted shall be valid for 3 calendar days.
A quotation for custom-made and/or customised products is only valid for the specifications on which it has been based. Any changes made require the issue of a new, updated quotation.
WARNING - The technical data sheets and details of each Product on the Site are constantly updated. Nevertheless, there may be errors and/or inaccuracies and/or mismatches between the descriptions and the actual Product.
Product descriptions on the site may be provided in several languages, translated automatically or manually. Despite efforts to ensure the accuracy of translations, discrepancies between language versions may occur. In case of doubt or differences in interpretation, the original Italian language version shall prevail. Compass DHM Projects accepts no responsibility for any errors in translation or interpretation that may affect your understanding of the features and specifications of the Products.
The photos included for each Product are indicative and not contractual, so they may not correspond in colour, size or accessories. It will be the Customer's responsibility to check that the product corresponds to the specifications indicated by the manufacturer.
The Company assumes no contractual, extra-contractual, or other liability for errors or omissions regarding the technical details of the products. Furthermore, the Company, where the Supplier of the Goods issues certifications and/or descriptive declarations of the product, shall comply with the same, deeming them to be compliant with the regulations in force, without assuming any contractual, extra-contractual or other type of liability for errors and/or omissions and/or violations of the law with respect to the technical and/or any other type of characteristics of the Goods. The Company may also make changes to the Goods in execution of the continuous programme of improvements and adjustments or in compliance with the legislation in force.
Article 4 - Storage of Products
Please pay particular attention to the following conditions.
The availability of the Products can be viewed in each Product tab and refers to the actual availability at the time the Customer places the order.
Products may have the following availability:
- Available: the product is in our warehouse.
- To order: the product is only available to order.
- Not available: the product is currently not available, but is expected to arrive.
Please note that availability must be considered purely indicative, as computer errors may occur regarding the quantities indicated. Moreover, due to the simultaneous presence of several Users on the Site, the Products may be sold to other Customers before the order is confirmed. We recommend that you consult the FAQ section on availability; please note that there is no return or refund for orders exceeding the quantities in stock.
Even after receipt of the order confirmation e-mail sent by Compass DHM Projects, cases of partial or total unavailability of the goods may occur. In such situations, the Customer will be contacted directly by the Seller to agree on a deferred delivery, an order modification or a rectification.
Article 5 - Terms of Payment
Payment methods are specified at the time of purchase. The following methods are available to the User: Paypal, bank or postal transfer in advance, Credit Card, Postepay, Cash on delivery.
CREDIT/DEBIT CARD: payment through Axerve - Banca Sella. In order to be able to pay by this method, the Customer will be required to provide his/her credit card details. Payment by credit card shall necessarily be made at the same time as the order is processed. The Company reserves the right to request the Customer to send copies of identity documents proving ownership of the card used. In the absence of the requested documentation, the Company reserves the right not to accept the order.
Paypal: payment through your Paypal account.
Alternatively, payment can be made directly online by Credit Card through Paypal, even without having an account.
You will be directed from the payment form to the Paypal screen, where you can optionally select 'I do not have a Paypal account' and enter all your card details to complete the payment.
The transaction is finalised on the Paypal site, so your card information is protected by security and prevention systems.
ADVANCE BANK TRANSFER: This method of payment, which may be requested at the Company's discretion, shall be made exclusively to the current account in the Company's name, which the Company shall specify from time to time. The Goods ordered by the Customer shall remain outstanding until receipt of proof of transfer no later than 5 (five) working days from the date of receipt of the order. Once these terms have expired, the order shall be automatically cancelled. In the case of payment by advance transfer (bank or postal transfer), the order will only be processed after receipt of confirmation of the credit transfer.
The data for making the transfer will be provided at the time of the Order Confirmation.
CASH ON DELIVERY: In addition to the payment methods listed above, there is also a 'Cash on Delivery' option. By choosing this option you can pay cash directly to the courier upon receipt of your order.
Cash on delivery is possible from a minimum amount of € 0.00 and a maximum amount of €500.00. There is a cash-on-delivery handling fee, which is explained in the order confirmation when selecting the payment method. Should the parcel be refused at the time of delivery, or should the delivery fail and the parcel be returned to the sender, the option of choosing cash on delivery will be blocked for the user.
BILLING
We issue an invoice with separate VAT indication. This is to be requested when confirming the order by checking the appropriate box and entering the necessary data (company name, registered office, tax code, VAT number and SDI code where necessary).
The invoice will be sent by e-mail to the e-mail address provided during registration.
In the event that the appropriate box is not ticked when placing the order, and consequently the request is not forwarded to the seller, the transaction will be recorded as received. It will therefore no longer be possible to request a commercial invoice for the order at a later date.
Article 6 - Acceptance and Cancellation of the Order
Compass DHM projects offers the possibility to change or cancel an Order according to the clauses specified herein.
Orders accepted by Compass DHM projects may be cancelled by the Client with the prior written consent of Compass DHM projects, provided that such order is not "Non-cancellable/Non- returnable", "Non-standard products" or governed by a letter of purchase agreement. Non- standard products are products that Compass DHM projects must order from a supplier specifically for the Client. This also includes products that are not normally in stock or orders in which value- added services have been incorporated into the products. Non-standard products are non- cancellable and non-refundable. Compass DHM projects may identify Products as non-standard by various means, including quotations, product lists, attachments.
The Client may not change, cancel or reschedule Orders for Products without the consent of Compass DHM projects. If after acceptance by Compass DHM projects of the Client's order, the Client cancels the order, Compass DHM projects may require the Client to pay Compass DHM projects reasonable cancellation or reliance fees. Such charges shall be paid to Compass DHM projects by the Client. Requests by the Client to reschedule are subject to acceptance by Compass DHM projects in its sole discretion.
The Customer may request the free cancellation of an Order only on the day of receipt of the Order Confirmation by the Seller, provided that the order is still in the status "awaiting payment" or "in processing".
Cancellation is free of charge only if the Customer sends a written notice to Compass DHM projects (in the manner specified below) within 2 hours of receipt of the Order Confirmation.
Requests for change or cancellation of orders must be sent via the 'Contact' form and must contain the order number and account reference.
In the event that these deadlines are not met, a cancellation fee in the amount of 50% of the order value will be charged to the Customer.
There shall be no cancellation of an order involving cutting to size and/or customised processing agreed upon with the Customer. Non-cancellable and non-returnable products are understood to be all products in the 'Customised processing' section.
The possibility of modifying or cancelling an Order is subject to the consent of Compass DHM projects, which, at its own discretion, expressly reserves the right to make exceptions to the clauses described herein in the event that cancellation cannot be accepted due to force majeure.
It is not possible to cancel an order once the dispatch process has started, which may begin at certain times of the day, even immediately after the order has been placed.
In the event that, at the time an order is cancelled, the corresponding payment has already been made, it will be necessary to contact the Seller via the "Contact" form in order to proceed with the refund procedure.
In such a case, the refund shall be activated by the Seller as soon as possible and in any event within thirty (30) days from the sending of the order confirmation using, where possible, the same payment channel with which the order was placed.
Compass DHM projects reserves the right to limit or cancel any order and to allocate sales at its discretion. It has the right to limit the quantities of selected Products and to restrict the availability of certain items to its Customers. In addition, Compass DHM projects reserves the right to refuse any order or part of an order. Product specifications and availability are subject to change without notice.
Article 7 - Processing times, delivery of goods and retention of title
Compass DHM projects ships Products within the European Union, but reserves the right not to accept orders that have PO Boxes or other locations specified to the Consumer at the time of order. The user may group several items into a single order. In this case he must add all items to the shopping cart and then proceed to complete the form.
In the event that the User places two or more orders separately, the Seller may make only one shipment for logistical reasons. In this case, there shall be no reimbursement for shipping and/or handling charges paid for the different orders.
With regard to packaging for small goods, padded envelopes are used. For bulky items, on the other hand, specially manufactured boxes and wrappers are used for greater strength and protection.
Packaging and shipping costs vary depending on the number of items, the type of packaging and the weight of the package.
The shipment is entrusted to the carrier according to the preparation and packing times specified for each item on https://www.dhm-online.com.
The delivery times indicated are purely indicative and not binding. They do not depend on the will of Compass DHM projects, which cannot be held responsible in any way for possible delays due to third parties or force majeure.
When placing an order, the customer undertakes to enter a correct delivery address, checking for errors before confirming the order.
Given the type of packaging, damage to the pieces during transport is very rare.
Nonetheless, the goods travel at the risk and peril of the buyer, who must check that the packaging is intact without any signs of tampering or damage when the material is delivered.
In this case, it is essential to sign the acceptance of the goods with reservation. If damage occurs, if there are any deviations from what was ordered or noted on the delivery note, these must be reported to the Seller in writing using the "Contact" form, within 48 hours of receipt of the package. Should the parcel return to our premises due to the recipient being unavailable, you will be charged for the costs of storage and return of the parcel.
If the courier's tracking code shows the package in the status refused by the addressee, or non- delivery due to an absent addressee, shipping costs will not be refunded and any return and storage costs will also be retained. It is the customer's responsibility to monitor the tracking of the parcel.
The Company shall not assume any liability for non-delivery of the Goods unless it has received within and no later than 10 (ten) days after the expiry of 48 hours from Order Acceptance a timely written notice, sent exclusively by registered letter with acknowledgement of receipt, or by PEC (compassdhmprojects@pcert.postecert.it), and addressed to the Company.
Delays in delivery and additional handling costs (to be borne by the Buyer) may occur for shipments to smaller islands or other remote areas.
The choice of courier is at the discretion of the Seller.
Ownership of the goods is not transferred to the Customer until final payment of the balance has been received by the Seller.
The Buyer shall pay all duties, excise, use and other taxes arising from this transaction (other than taxes based on the Seller's revenues).
Article 8 - Right of Withdrawal
Purchases made from the website https://www.dhm-online.com or through Direct Sale, provide the Consumer with a period of 14 days to withdraw from the Distance Contract (in accordance with the provisions of Legislative Decree 21/2014 implementing Directive 83/2011/EU on consumer rights). The fourteen days shall be understood as starting from the moment when the Consumer or a third party, other than the carrier and designated by the Consumer, acquires physical possession of the goods.

It should be noted that Community law provides that the right of withdrawal may only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, CANNOT be exercised by legal persons and natural persons acting for purposes related to a commercial activity.
Also excluded from the right of withdrawal are purchases made by resellers or persons who in any capacity purchase for resale to third parties.
ATTENTION: The right of withdrawal does not apply to the supply of custom-made or customised goods, the supply of sealed electronic materials and any other goods that, due to their nature, cannot be returned or are liable to deteriorate or alter rapidly. This includes, for example, customised cutting of sheet metal and shafts, customised kits and other similar items.
It should also be noted that, in the case of prize operations (so-called promotions), in which the purchase of one good is combined with another good that is sold at a lower price than the list price, the right of withdrawal will be legitimately exercised with the return of both goods purchased, given the constraint of the ancillary nature of the promoted good with respect to the first.
The Products subject to reconsideration must be returned by the Consumer in conditions of substantial integrity (with traceable shipment). Once we receive the goods and verify their actual integrity, we will credit the cost of the returned Products to the Customer, retaining the amount of the shipping and packaging costs paid at the time of purchase.
The costs and risks associated with returning the Products will be borne by the Customer. Handling fees may apply depending on the type of order. Fees will not be reimbursed in case of return or cancellation of the order.
Goods returned after 14 days because they are unwanted or wrongly ordered may be accepted at the Company's discretion, but will be subject to a handling and return charge of 20% of the invoice value, with a minimum of € 10.
Compass DHM projects will not accept cash on delivery shipments. Some products may require return directly to the manufacturer.
By returning the products to Compass DHM projects, the Client certifies that the products have been purchased from Compass DHM projects and that no full or partial replacement of the same product has been made by another supplier, distributor or other source of the product.
The right of withdrawal lapses completely: if it is ascertained that the Product has been used, even partially, if it is ascertained that integral elements of the Product (accessories, manuals, etc.) are missing, in the event of partial or total damage to the Product or parts thereof, in the event of absence of or damage to the original packaging.
If any of the above conditions are met, no refund or exchange of goods will be made.
Article 9 - Liability and guarantees
Compass DHM projects agrees to transfer to the Client any transferable warranties that Compass DHM projects receives from the manufacturer of the Products sold to the Client. Compass DHM projects makes no other warranties, express or implied, with respect to the Products. In particular, Compass DHM projects makes no warranty as to the merchantability of the Products or their fitness or suitability for any particular purpose or use, or as to non-infringement.
Compass DHM projects shall not be liable for any inefficiency due to force majeure or unforeseeable circumstances, even if dependent on malfunctions and failures of the Internet network, which prevent, in whole or in part, the execution of the order in the time provided for by the Contract. Force majeure or unforeseeable circumstances shall be deemed to include accidents, strikes, bad weather, fire, power failure, difficulty in obtaining materials, equipment, labour or
transportation, government restrictions, serious public health disturbances or any similar cause over which the Seller is unable to exercise any control.
The liability of Compass DHM projects arising out of any sale of Products to the Client is expressly limited to (1) Reimbursement of the purchase price paid by the Client for such Products (without interest), or (2) Repair and/or replacement of such Products, at the option of Compass DHM projects, with such remedies being exclusive and to the exclusion of all others. The Client shall notify Compass DHM projects within 90 days from the date of shipment of any defective Product. This warranty excludes all other warranties, whether oral, written, express, implied or statutory. Implied warranties of fitness for a particular purpose and merchantability are expressly excluded and shall not apply. The obligations of the Customer and the remedies of Compass DHM projects with respect to defective or non-conforming products are solely and exclusively those set forth herein.
Furthermore, no warranty shall apply if the Product has been subject to misuse, electrostatic discharge, neglect, accident, modification or has been welded or altered in any way.
Attention: In no event, in the case of issues or damage to the received materials, will a refund be issued for an amount greater than what was paid at the time of the order. Additionally, in case of a dispute, returns from addresses in countries other than the one where the original order was placed will not be accepted. Should any taxes or customs duties be requested by the courier at the time of return, these amounts will be deducted from the refund total.
Limited warranty period
Please note that some products come with a limited warranty and reference will be made to the precise conditions of the specific manufacturer.
Consumable parts without warranty
Some products on https://www.dhm-online.com are to be considered as 'consumables'. This indicates that these are disposable items, parts or components that are subject to deterioration and wear during normal use. These consumables include, but are not limited to: Hotends and their parts (hotend cooling fans, heater, thermistor and silicone sock for hotend, nozzles), extruder gears for 3D printers, Print Plates, Magnetic Plates, Adhesives for Print Plates, PTFE tubing and pneumatic connectors.
These items are not subject to warranty. However, in the event of manufacturing defects and at the Manufacturer's discretion, the final decision on replacement will be at the discretion of Compass DHM projects and will be final.
9.1 - Consumer guarantee
Following the notification of a conformity defect, Compass DHM Projects may offer the Consumer- Client various remedy options, with the following effects:
· If the Consumer-Client has already requested a specific remedy, Compass DHM Projects shall proceed to implement it, unless the proposed alternative remedy is expressly accepted.
· If the Consumer-Client has not yet requested a specific remedy, it must accept the proposal or reject it, opting for another remedy as provided for in this clause.
A minor lack of conformity, for which it is not possible or excessively onerous to proceed with the remedies of repair or replacement, does not entitle the parties to terminate the Contract.
Direct action by the consumer to assert defects in the Products shall be time-barred within 24 (twenty-four) months after delivery of the Products.
The warranty period for new products is that provided by the manufacturer. For used goods, marked in the individual offers as fully serviced and/or demonstration, the warranty period is 12 months. The warranty period runs from the date of the invoice issued by Compass DHM Projects for the Product.
9.2 - Warranty in favour of the Professional Client
Compass DHM projects undertakes to replace defective Products at no cost to the Customer. In any event, the warranty of Compass DHM projects shall be limited to the replacement of the Product supplied and acknowledged to be defective and shall not give rise to any claim for damages, including any liability for indirect, immaterial and unforeseeable damages, irrespective of their origin, including, but not limited to, any liability for loss of anticipated profits, any finance charges, loss of income.
The guarantee does not apply if:
· the Customer uses the Products after having sent the objection;
· the defect occurs because the Customer has not followed the instructions for the storage, installation, use or maintenance of the Products;
· the Client has modified the Products in question without the written consent of Compass DHM projects;
· the delivered Product has undergone a change after delivery causing a defect.
Compass DHM projects makes no warranties, express or implied, in particular as to the suitability of the Products for the specific purposes intended by the Customer.
The effectiveness of the guarantee presupposes that the Customer has notified the defect in writing no later than ten (10) working days after delivery, and that Compass DHM projects has been able to carry out the necessary checks on the Products in question. Hidden defects shall be notified within the same period after their discovery.
If the defect manifests itself after 6 months following delivery, it is up to the Client to prove that the product was also defective at the time of delivery. Otherwise Compass DHM projects shall be entitled to certify that the product was free of defects at the time of delivery.
The warranty period for new Products is that offered by the Manufacturer. The warranty for used Products marked in the individual offers as fully serviced and/or demonstration is 12 months. The warranty period runs from the date of the invoice issued by Compass DHM projects in relation to the Product sold.
Article 10 - Limitation Of Liability
Compass DHM Projects cannot be held responsible for any fraudulent or illegal use that third parties may make of credit cards or other means of payment during the purchase of the Products on the website https://www.dhm-online.com. In fact, during the entire purchase process, the Seller does not have access to the Buyer's credit card number, as this is transmitted directly to the bank service provider via a secure connection.
COMPASS DHM PROJECTS WILL NOT IN ANY EVENT BE LIABLE FOR SPECIAL, INCIDENTAL OR
CONSEQUENTIAL DAMAGES OF ANY KIND, including but not limited to damages for loss of profits or revenue, recall costs, claims for interruption of service or non-delivery, testing, installation or removal costs, replacement product costs, property damage, personal injury, death or legal fees. The compensation payable to the Client by Compass DHM Projects for any claim will not exceed the purchase price paid for the goods, regardless of the nature of the claim, whether related to warranty, contract or otherwise.
The Client shall indemnify, defend and hold Compass Dhm Projects harmless from any claims made by third parties relating to the products supplied by Compass Dhm Projects and integrated into the Client's product.
Article 11 - Copyright Protection
The information, logos, graphics, images, trademarks and anything else published and/or reproduced on https://www.dhm-online.com are the property of Compass DHM projects, or granted by third parties for use by Compass DHM projects.
Reproduction of the content of the Site is only permitted with the prior written authorisation of the Seller. It is therefore forbidden to reproduce, even partially, the textual and non-textual contents of the Site - All rights reserved.
Compass DHM projects is only responsible for the official site at https://www.dhm-online.com, and cannot therefore be held responsible for clone sites set up for scams or otherwise by others.
Compass DHM projects is also not liable in the event that material on the Site, including logos, is used for illegal purposes by other persons.
Article 12 - Privacy policy and cookies
Information document pursuant to Article 13 of EU Regulation 2016/679 - GDPR Information on the processing of personal data collected from the data subject.
In accordance with EU Regulation 2016/679 (General Data Protection Regulation - GDPR), we provide the necessary information regarding the processing of personal data provided by the User. This information applies exclusively to data collected on the owner's website and does not apply to other websites that may be consulted through links on our site, for which Compass DHM Projects is not responsible.
The information is provided pursuant to Article 13 of EU Regulation 2016/679 and also takes into account the provisions of Directive 2002/58/EC, as amended by Directive 2009/136/EC, on the subject of cookies, as well as the provisions of the Data Protection Authority's Measure of 8 May 2014 on the use of cookies.
